Your reports are important!

The Festo Group scores points for innovation, quality, and performance – characteristics that strengthen the trust of employees and business partners in its credibility and integrity. Festo has an excellent reputation with the general public and its various business partners. The protection of this trust, integrity, and reputation by means of perfectly ethical and lawful conduct is a top priority for Festo. To protect these characteristics of Festo and avert potential damage to the company, learning about compliance violations is an important concern. Festo places great importance in an open, value-oriented company culture. It encourages employees and third parties who have become aware of compliance risks and, in particular, detected compliance violations to approach points of contact within the company, e.g. executive staff, HR, the Chief Compliance Officer, or the local Compliance Officer.

Festo further offers its employees, customers, suppliers, and other business partners a secure way of reporting potentially severe compliance violations: its secured whistleblowing portal, the BKMS® System. This channel of communication allows for the submission of relevant information worldwide, at any time, securely, and confidentially. Submitted reports will be forwarded to the Compliance department of Festo AG & Co. KG, which is managed by the Chief Compliance Officer and responsible for the further, confidential processing of the report.

The whistleblowing portal helps with the detection and prevention of severe compliance risks to the company, especially risks that are harmful to business. For this reason, only reports relating to severe compliance risks will be received and processed through the whistleblowing portal, particularly those belonging to the field of white-collar crime (e.g. acts of corruption), antitrust law, data protection, and breaches of the Festo code of conduct.

Denouncing another person can lead to serious consequences for the affected party. It is therefore of paramount importance that the whistleblowing portal is used responsibly, and never abused for the submission of insulting, libellous, or otherwise decrying reports that disadvantage another person (e.g. an employee/colleague) without any incriminating facts. A whistleblower is encouraged to only provide information whose correctness the whistleblower is convinced about to the best of its knowledge and belief. Knowingly submitting false information can result in prosecution under criminal and labour laws.

For simplifying the readability, this portal does not make separate reference to male or female employees, but when referring to "employee", both genders are included and treated as a synonym. No discrimination is intended in any way.

  • Why should I submit a report?

    We consider the mutual trust between our company, our business environment (business partners, customers), and our employees to be our most valuable asset. We want to set standards - not only for our competence, performance, and service, but also in terms of our ethical conduct within our business environment. This includes the observance of our code of conduct, upholding of values and duties, and compliance with legal regulations.

    You might be aware of harmful acts that damage our company. You might also feel hesitant to disclose this information personally.

    We want to effectively protect you, the whistleblower: the present communication platform is secured with state-of-the-art technology and allows you to submit reports either under your own name or, if preferred, anonymously. You can further set up an anonymous postbox in order to make an active contribution to the solution of the case.

    Each individual member of our company is responsible for protecting it from damage.

  • Which incidents can be reported?

    Compliance violations of any kind – i.e., any violation of legal standards or general ethical codes of behaviour – can be reported.

    You can submit reports about situations that directly or indirectly affect Festo.

    This includes the following:

    • Violations of our code of conduct
    • Violations of competition and cartel law
    • Criminal offences in the area of corruption (Bribery, granting and requesting illegal advantages)
    • Actions which leads to conflicts of interest
    • Violations of rules/laws in the area of safety at work, protection of health, company security and protection of the environment
    • Violations of regulations with respect to anti-discrimination and anti-bullying regulations
    • Violations of data protection regulations
    • Unacceptable working conditions at facilities operated by our business partners

    You will receive detailed information on the possible categories of a report during the reporting process.

  • How will my report be processed, how do I set up a postbox?

    If you wish to submit a report by name or anonymously, click the "Submit report" button on the top left of our introduction page.

    The reporting process consists of 4 steps:

    1. First of all, you will be asked to read an information text for the protection of your anonymity and to answer a security query.
    2. On the following page, you will be asked about the category of your report.
    3. On the report page, phrase your information in your own words and select answers to questions about the case. You may use up to 4,096 characters in the free-text field, which corresponds to a full DIN A4 page. You may also attach files up to 2 MB to support your report. Keep in mind that electronic documents may contain information about the author. After submitting your report you receive a reference number as proof that you submitted this report.
    4. Finally, you will be asked to set up your own secured postbox. You will receive feedback from us via this postbox, including answers to questions and information about the progress of your report.

    If you already have a secured postbox, you can access it directly via the "Login" button. You will have to confirm the security query firstly here as well.

    As long as you do not enter or attach any data that could reveal your identity, the BKMS® System protects your anonymity by means of a certified technical solution.

    We can assure you that we are only interested in the incidents you have reported. The objective is to detect deficiencies early on and to prevent financial damages.

  • How can I receive a reply, yet at the same time remain anonymous?
    The utmost principle of the BKMS® System is to protect the whistleblower's identity. The functionality of anonymity protection is certified and can be checked by you at any time.

    You choose your own pseudonym / username and password when you set up your secure postbox. Encryption and other special security methods ensure that your report remains anonymous at all times. At no time during the reporting process will you be asked for personal information. Do not submit any information that can be traced back to your personal identity. Please do not submit your report on a PC provided by your employer.

    The person in charge of your report will contact you via your secured postbox to provide information about the status of your report or to ask further questions if certain details need to be clarified. Your anonymity will always be protected during this process. We are interested in these reports in order to prevent damages, not to get information about the person who submitted them.

  • Data Protection Information

    We take data protection and confidentiality very seriously and adhere to the current national and European data protection regulations. The following section will briefly outline the most important aspects of our data storage system.

    The present site provides information on our handling of reports submitted through the whistleblowing portal, and explains how we ensure that the confidentiality of your report will be protected.

    Confidential handling of reports

    Incoming reports are received by specially trained employees of the Corporate Compliance Management Departments of the Festo Group, and are always treated with strict confidence. The responsible Corporate Compliance Management staff will examine the situation and pursue further investigations. They are authorised to forward the case to a law enforcement agency if a breach of the law is suspected, and disclose it to an internal point of contact if appropriate (e.g. the HR Department for initiating punitive measures against the perpetrator).

    The follow-up process may require the forwarding of reports to other employees of the Festo Group or Festo Group members, e.g. if the reports pertain to incidents taking place in subsidiaries of the Festo Group. The latter may be based in countries outside the European Union or the European Economic Area with different regulations about the protection of personal data. Even in the latter case, however, we will always adhere to the strict guidelines set by European data protection standards.

    The honest use of the whistleblowing portal will not have any adverse consequences for whistleblowers. In the case of improper use, such as the deliberate submission of false reports with the intent of discrediting an individual, we reserve the right to take action against the whistleblower.

    Information about the accused

    We are legally obliged to inform accused parties of any reports received against them as soon as the disclosure of this information no longer jeopardises the investigation. Your identity as a whistleblower will not disclosed unless we are legally bound to do so.

    Use of the whistleblowing portal

    Communication between your computer and the whistleblower portal takes place over an encrypted connection (SSL). Your IP address will not be stored during your use of the whistleblowing system. A cookie will be stored on your computer in order to maintain the connection between your device and the BKMS® System. This cookie only contains your session ID. The cookie is only valid until the end of your session and expires upon logout or closing the browser.

    Your visit to the whistleblower portal may leave traces on your computer, however. If you are accessing the whistleblower portal from a company computer, you might want to clear the temporary files (cache) and browser history afterwards. Some browsers also offer a so-called “private mode“. This mode is preferable: no temporary data are stored, and you do not need to delete anything manually.

    It is possible to set up a postbox within the whistleblowing system that is secured with an individually chosen pseudonym / user name and password. This allows you to send reports to the responsible Festo Group employee in an anonymous, safe way. This system only stores data inside the whistleblowing system, which makes it particularly secure. It is not a form of regular e-mail communication.

    Note on sending attachments

    When submitting a report or an addition, you can simultaneously send attachments to the responsible Festo Group employee. If you wish to submit an anonymous report, please take note of the following security advice: Files can contain hidden personal data that could endanger your anonymity. Remove these data before sending. If you are unable to remove these data or are unsure how to do so, copy the text of your attachment into your report or send the printed document anonymously to the address of the recipient (see footer), citing the reference number received at the end of the reporting process.

    Your rights regarding the processing of your personal data

    Pursuant to German data protection legislation, you have a right of information, correction, deletion, and locking your personal data. You are entitled to retract your consent to the storage of your personal data at any time without giving reasons. In this case, the necessity of the stored data for the examination of a report will be evaluated immediately. Data that are no longer required will be deleted at once.

    Storage period

    We store reports for the duration of their relevance to the investigation of the respective case, or for as long as we have a legally justified motivation to store them. After that period, reports will be deleted or anonymised, i.e. any links to your identity as a whistleblower and to persons named in the report will be removed permanently and irreversibly.

    Responsible authority and data security

    The data protection authority connected to the whistleblowing portal is Festo AG & Co. KG, Corporate Compliance, Siemensstraße 12, 73760 Ostfildern-Scharnhausen, Germany. The whistleblowing portal is operated on behalf of the Festo Group by a specialised company: Business Keeper AG, Bayreuther Str. 35, 10789 Berlin, Germany. All data in the whistleblowing portal are secured by extensive technical and organisational measures and encrypted to ensure that Business Keeper AG does not have access to the data, and only specific authorised persons within the Festo Group can access them.
